I was getting that same thing, an update is available and I couldn't download it. After launching Halo 2 as an admin it failed initially to download the update, but then I was messing around in my LIVE profile area and it downloaded and worked fine.
Lucky timing? Fluke? No idea, all I know is that is what I was doing when it updated.
